General Terms and Conditions

 
1. Scope

The following Terms and Conditions apply to all orders placed via our online shop. Our online shop is intended exclusively for consumers.

A consumer is any natural person who concludes a legal transaction for purposes that predominantly cannot be attributed to their commercial or independent professional activity. An entrepreneur is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of their commercial or independent professional activity.

 

2. Contractual partner, conclusion of contract, correction options

The purchase contract is concluded with APU KUNTUR GmbH.

By placing the products in the online shop, we submit a binding offer to conclude a contract for these items. You can initially place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction tools provided and explained in the ordering process.

The contract is concluded when you accept the offer for the goods contained in the shopping cart by clicking the order button. Immediately after submitting your order, you will receive a confirmation by e-mail.

 

3. Contract language, storage of contract text

The languages available for the conclusion of the contract are German, English and French.

We store the contract text and send you the order data and our Terms and Conditions in text form. You can view the contract text in your customer login.

 

4. Subject of the contract

Reference is made to the validity of the respective product description as an essential part of the contract.

Without prejudice to your statutory warranty rights, we would like to point out the following. If you are unsure, please contact us:

Due to individual screen configurations (e.g. resolution and brightness), slight deviations between the displayed and the actual product colors may occur.

 

5. Delivery conditions

5.1 Delivery area

We deliver worldwide.

Currently excluded from delivery are addresses in the USA, the United Kingdom and Brazil.

5.2 Shipping costs

In addition to the stated product prices, shipping costs may apply.

The respective shipping costs will be displayed during the ordering process and can be viewed before submitting your order.

5.3 Delivery options

We ship the products to the delivery address specified in the ordering process.

In principle, you also have the option of collecting your order at:

6. Payment

6.1 Prices

The prices stated at the time of the order apply. These are total prices and include statutory VAT.

6.2 Due date and default of payment

The price is due upon conclusion of the contract unless a later date results from the following payment conditions.

6.3 Payment methods

The following payment methods are generally available in our shop:

Bank transfer
If you choose bank transfer, we will provide you with our bank details after completion of the order and in the separate order confirmation e-mail. The goods will be delivered after receipt of payment.

Debit/credit card
You enter your card details during the order process. Your card will be charged immediately after placing the order.

PayPal
To pay via PayPal (Europe) S.à r.l. et Cie, S.C.A, you must be registered with PayPal, log in with your access data and confirm the payment instruction. The payment transaction is carried out immediately after placing the order. Further information is provided during the ordering process.

PayPal may offer additional payment methods to registered customers based on its own criteria. We have no influence on this. Any additional payment methods offered individually affect your legal relationship with PayPal. Further information can be found in your PayPal account.

Riverty/purchase on account
Our external service provider Riverty offers the payment method “purchase on account.” With individual invoices, you can conveniently pay for your online purchases by invoice. If you do not make payment within the specified time frame, you will receive a monthly invoice from Riverty in the following month with an overview of your orders.

When concluding the purchase contract, Riverty assumes the resulting receivable and handles the corresponding payment modalities. By choosing purchase on account, you also accept Riverty’s Terms and Conditions.

Please note that purchase on account is only available in Germany, Austria, the Netherlands and Belgium.

 

7. Retention of title

The goods remain our property until full payment has been received.

 

8. Transport damage

If goods are delivered with obvious transport damage, please report such defects to the delivery agent immediately and contact us without delay. Failure to make a complaint or contact us has no consequences for your statutory claims and their enforcement, in particular your warranty rights. However, it helps us to assert our own claims against the carrier or transport insurance.

 

9. Warranty and guarantees

10. Liability

We are fully liable for claims arising from damages caused by us, our legal representatives or vicarious agents:

  • in case of injury to life, body or health,
  • in case of intent or gross negligence,
  • in case of guarantee commitments, where agreed, or
  • insofar as the scope of the Product Liability Act applies.

In the event of a breach of essential contractual obligations, the fulfilment of which is a prerequisite for the proper execution of the contract and on whose compliance the contractual partner may regularly rely (cardinal obligations), due to slight negligence on our part, our legal representatives or vicarious agents, liability is limited in amount to the damage foreseeable at the time of conclusion of the contract, the occurrence of which must typically be expected.

Otherwise, claims for damages are excluded.

12. Dispute resolution

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

If individual clauses of these Terms and Conditions are wholly or partially invalid, the remainder of the contract shall remain valid. Where individual clauses are invalid, the content of the contract shall be governed by statutory provisions.
